Grandparents Rights in California

Under California Law, grandparents are entitled to visitation and may seek custody of their grandchildren in very limited situations.  Courts must weigh the parents’ rights to make decisions regarding their children and the exercise of parental authority against a grandparent’s right to obtain reasonable visitation rights.

Grandparents may seek visitation rights if any of the following situations exists:

• A parent is deceased.

• The child’s parents have a divorce or family law case pending and custody is an issue.

• The child’s parents were never married.

• The parents are married but are permanently or indefinitely separated.

• The parents are married but the whereabouts of one parent is unknown.

• The child does not reside with either parent.

• The child has been adopted by a step-parent.

• One parent consents to grandparents’ visitation.

In order to grant a petition for visitation rights with a child’s grandparents, the petitioner must demonstrate that there is a pre-existing bond between the grandparent and the grandchild.  However, the Court must still determine if the relationship is so strong that visitation with the grandparents is in the best interests of the child.
